GLENFIDDICH GRANDE COURONNE X JORDAN DALAH BALLOT

Terms and Conditions

1. Information on how to register forms part of these Terms and Conditions. Registration and participation in this ballot is deemed acceptance of these Terms and Conditions.

2. Registration is only open to Australian residents aged 18 years or older.

3. Employees (and their immediate families) of the Promoter and agencies associated with this ballot are ineligible to register. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. Registration into the ballot opens on 30/05/2022 and closes at 11:59pm AEST on 17/06/2022 (“Registration Period”).

5. To register, individuals must visit complete the following steps during the Registration Period:

  • Visit www.glenfiddich.com/au/grande-couronne-jordan-dalah-ballot and follow the prompts to the registration page;
  • Complete the registration information in full, including selecting which box set colour they wish to register for being either red/white, blue/green or red/navy;
  • Provide credit card details, which the participant expressly authorises to be charged in the event they are selected; and
  • Submit the fully completed registration form.

6. Only one (1) registration permitted per person for each box set colour category. Maximum of three (3) registrations permitted per person overall.

7. The Promoter reserves the right, at any time, to verify the validity of registrations and participants (including a participant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the registration process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the ballot. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

8. Incomplete or indecipherable registrations will be deemed invalid.

9. If there is a dispute as to the identity of a participant, the Promoter reserves the right, in its sole discretion, to determine the identity of the participant.

10. Ballot selection will take place at Anisimoff Legal, Suite 5, 210 The Central Coast Highway, Erina NSW 2250 at 9am AEST on 20/06/2022. The Promoter may select additional reserve selections, and record them in order, in case of an invalid registration or ineligible participant.

11. The successful participants will be notified by email.

12. The Promoter’s decision is final and no correspondence will be entered into.

13. Registrations will be divided into three (3) groups depending on the box set colour preference selected at the time of registration, being either red/white, blue/green or red/navy. The first twenty (20) valid registrations selected in each group, will each be authorised to purchase a limited edition Glennfiddich Grande Couronne x Jordan Dalah box set for AUD$2,699. Each box set includes 1 x limited edition Jordan Dalah shell (in either the relevant colour selected by the participant), 1 x 700mL bottle of Glennfiddich Grande Couronne with Jordan Dalah graphic, 6 x Grande Couronne glasses and 1 x unpublished limited edition A1 print from Jordan Dalah’s runway show or Grande Couronne campaign, signed by Jordan Dalah. Successful participants will be charged the AUD$2,699 purchase amount to the credit card provided at the time of registration.

14. For the removal of doubt, successful participants in the ballot will not win the box set. Successful participants in the ballot will be authorised to purchase the box set for AUD$2,699, which will be debited from the credit card provided at the time of registration within two (2) business days of selection. The box set will not be available for sale outside of this ballot.

15. Participants consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful participant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this ballot (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

16. If the ballot is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any participant; or (b) to modify, suspend, terminate or cancel the ballot, as appropriate.

17. Any cost associated with accessing the registration website is the participant’s responsibility and is dependent on the Internet service provider used.

18. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the ballot.

19. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any registration that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or (d) any tax liability incurred by a participant.

20. The Promoter collects personal information ("PI") in order to conduct the ballot and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and suppliers. Participation is conditional on providing this PI. The Promoter will use and handle PI as set out in its Privacy Policy, which can be viewedat www.glenfiddich.com/uk/shop/privacy-cookies-notice.
